By using the My Energy Solutions Web site,
you expressly agree that use of the My
Energy Solutions Web site is at your sole
risk. The My Energy Solutions Web site is
provided on an "AS IS" and "as available"
basis. Neither My Energy Solutions nor its
parent company, affiliates, subsidiaries or
designees nor each of their respective
officers, directors, employees, agents,
third-party content providers, designers,
contractors, distributors, merchants,
sponsors, licensors or the like
(collectively, "Associates") warrant that
use of the My Energy Solutions Web site will
be uninterrupted or error-free. Neither My
Energy Solutions nor its Associates warrant
the accuracy, integrity or completeness of
the content provided on the My Energy
Solutions Web site or the products or
services offered for sale on the My Energy
Solutions Web site. Further, My Energy
Solutions makes no representation that
content provided on the My Energy Solutions
Web site is applicable to, or appropriate
for use in, locations outside of the United
States. My Energy Solutions and its
Associates specifically disclaim all
warranties, whether expressed or implied,
including but not limited to warranties of
title, merchantability or fitness for a
particular purpose. No oral advice or
written information given by My Energy
Solutions or its Associates shall create a
warranty. Some states do not allow the
exclusion or limitation of certain
warranties, so the above limitation or
exclusion may not apply to you. Average
savings claims of 10% to 25% are made to us
directly by our customers and could mean
customers save anywhere from 5% to 50% on
their energy bills. Products of My Energy
Solutions are not warranted (they are not
under warranty)
under any circumstance by the manufacturer
against power surges and "acts of God".
If there is a power surge from the
Electrical provider, lightning strikes, or
acts of God, products by My Energy Solutions
are helpful in regulating electrical spikes
that would otherwise be a problem for your
appliances, but it should not be confused
with a whole house surge protector. This
includes the
Energy Smart Unit™ which helps regulate
power surges in homes and businesses.
Under no circumstances shall My Energy
Solutions or its Associates be liable for
any direct, indirect, incidental, special or
consequential damages that result from your
use of or inability to use the My Energy
Solutions Web site, including but not
limited to reliance by you on any
information obtained from the My Energy
Solutions Web site that results in mistakes,
omissions, interruptions, deletion or
corruption of files, viruses, delays in
operation or transmission, or any failure of
performance. The foregoing Limitation of
Liability shall apply in any action, whether
in contract, tort or any other claim, even
if an authorized representative of My Energy
Solutions has been advised of or should have
knowledge of the possibility of such
damages. User hereby acknowledges that this
paragraph shall apply to all content,
merchandise and services available through
the My Energy Solutions Web site. Under no
circumstances shall My Energy Solutions or
its Associates be liable for any direct,
indirect, incidental, special or
consequential damages that result from your
use of product sold by My Energy Solutions –
this includes any non-licensed installation
by the customer or others. Customers who
choose to install or open the casing of My
Energy Solutions products are in violation
of these terms and said products’ warranties
will be null and void. In addition, the
Energy Smart Unit must be properly grounded
or the warranty is void and we will not
accept returns if the building on which the
Energy Smart Unit is installed upon is not
grounded. If customer has been advised that
the customer’s location requires more than
one Energy Smart Unit and only installs less
than the recommended number of Energy Smart
Units, no warranty from My Energy Solutions
will apply to any units installed at that
location. If repair is needed then it must
be performed by a licensed technician. It is
the customer’s responsibility to contact a
licensed technician and contract them to
work on the product. Some states do not
allow the exclusion or limitation of
incidental or consequential damages, so the
above limitation or exclusion may not apply
to you.
Return Policy
All sales made through the My Energy
Solutions Web site are subject to My Energy
Solutions’ return policy. Customers have 30
days to return any items for a full refund
if items have not been tampered with or
installed. After 30 days My Energy
Solutions will not accept any returns unless
the following criteria are met. Items can be
returned if they comply with the warranty
and money back guarantee.
Energy Smart Unit Money Back Guarantee
If customer does not see at least 5% average
reduction in kWh consumption on customer’s
electric bill for the first twelve
consecutive months after installation,
customer may return the item for a full
refund of the purchase price. Customer must
provide the electric bills of the location
where the Energy Smart Unit was installed
for the twelve consecutive months directly
prior to installation as well as the twelve
consecutive months of electric bills after
installation. These bills must show that kWh
consumption was not at least 5% lower than
in the prior year. In these cases, shipping
labels will be sent to customer by email for
customer to use to ship the item back to My
Energy Solutions, unless Energy Smart Unit
was purchased from an authorized dealer.
Authorized dealers may take returns directly
and submit returns to My Energy Solutions in
accordance with their contract with My
Energy Solutions. If customer has been
advised that the customer’s location
requires more than one Energy Smart Unit and
only installs less than the recommended
number of Energy Smart Units, the Energy
Smart Unit Money Back Guarantee will not
apply to any units installed at that
location. In addition
Energy Smart Unit Money Back Guarantee is
valid under the following conditions are met
for the first 12 billed months of use:
1 - No additional electrical appliances, gas
powered appliances, electrical wiring,
circuit panels, or lighting is installed in
the home or business
2 - No additional occupants
3 - No extreme variations in climate of
climate controls at the location where the
Energy Smart Unit is installed
In the case of damaged products from the
shipper, a claim will have to be made with
the shipper for the damaged product. If the
customer complies with the claim and the
claim has been completed we will ship
another product. However if the shipper
finds that the customer is responsible for
the damaged product, then it’s the
customer’s responsibility for the order of a
new product, plus the shipping. In this case
My Energy Solutions will offer a discount at
its sole discretion. If product is deemed
defective by licensed technician, and was
not damaged by shipping, then My Energy
Solutions will replace the product within 30
days at no additional charge to the
customer.
Shipping
Shipping costs will be noted per item during
the checkout process or you may estimate
shipping costs from the cart before
checkout. We will automatically default to
the least expensive method of shipping
available, but you will have the option to
upgrade your shipping to a different service
during the checkout process. If Standard
shipping is not available for the item you
selected, your shipping level will default
to Expedited service.
Shipping cost is calculated on a "per item"
or "per pound" basis and is based on the
level of shipping service selected
(Standard, Expedited, Express). We ship
through FEDEX, UPS, or USPS.

Order Limitations
We reserve the right to reject any order you
place with us, and/or or to limit quantities
on any order, without giving any reason. If
we reject your order, we will generally
attempt to notify you using the e-mail
address you gave us when you placed the
order.
Termination of Use
My Energy Solutions may, at its sole
discretion, terminate your account or your
use of the My Energy Solutions Web site at
anytime. You are personally liable for any
orders that you place or charges that you
incur prior to termination. My Energy
Solutions reserves the right to change,
suspend or discontinue all or any aspects of
the My Energy Solutions Web site at any time
without prior notice.
